When the CPSIA was passed in 2008, it mandated independent 3rd party oversight of all children’s products, with the primary goal to reduce hazards to children’s toys. All toys designed or intended primarily for children 12 years of age and younger must be third-party tested for chemical and performance safety standards, and be certified by the supplier that it meets these stringent requirements. One of the primary risks with jewelry is that it may contain toxic heavy metals which can cause reproductive harm in young children. Mouthing or swallowing small metal jewelry components can not only be a choking hazard but a chemical toxicity hazard. International, USA federal and state regulations have mandates for such requirements under statutes and consent judgements such as California’s proposition 65 – requiring testing for lead and cadmium in jewelry.

Manufactures and importers of children’s products are required to follow certain testing and certification protocols established by the US Consumer Product Safety Commission. The law defines a children’s product as a consumer product designed or intended for a child 12 years of age or younger. Children’s products are required to undergo third party testing and to have a written Children’s Product Certificate demonstrating compliance. ACT Lab is devoted to complying with CPSC-administered regulations and can perform various tests to ensure that children’s products follow CPSC regulations.

The manufacturing of diverse consumer products is growing at an incredible rate. According to Forbes, in 2010, 250,000 products were launched with a failure rate of 85-95%. Chemical Testing

ACT offers a wide range of chemical testing services to help companies confirm their products maintain levels of any hazardous substances below regional or internal limits or bans. Under legislation such as USA’s Consumer Product Safety Improvement Act (CPSIA), Europe’s RoHS Directive, or California’s Proposition 65 Hazardous Water Act, heavy metal elements such as Lead, Cadmium, Mercury, and plasticizers or Phthalates have been restricted at various levels, with products geared towards children having the most stringent requirements. Our team of chemical experts provide accurate and reliable testing services with the goal to ensure that products are safe for consumer use and the environment.

Testing Services

Whether children’s toys, bicycles, apparel, or jewelry, lead is one of the primary chemicals – heavy metals – monitored worldwide as a banned toxic substance. Paints and substrates, metals and non–metals are all measured every day for concerns over high levels of lead. All children’s products must undergo third party testing to ensure that products do not contain a concentrations that could cause toxic harm to consumers.

Like lead, cadmium and mercury exposure may also cause a variety of heath and reproductive issues at toxic levels in the human body. Both metals have been used as lead replacements in manufacturing over the years, but governments have also banned total and soluble concentration of these as well in order to product the health of consumers.

In very small amounts, many heavy metals are relatively harmless and are essential for production. However, in larger amounts, they may become toxic. Metals such as Antimony, Arsenic, Barium, Cadmium, Chromium, Mercury, Selenium, and Lead are individual metals that can negatively affect people’s health, and are regulated under a variety of international toy and consumer product safety standards.

Phthalates are chemical plasticizers that are often used in the production of many types of plastics to make plastics softer and more pliable. Congress has permanently banned three types of phthalates greater than .1 percent in children’s products: DEHP, DBP, and BBP. The CPSIA has also banned DINP, DIDP and Dn0P on an interim basis meaning that limits apply to children’s toys that can be placed in a child’s mouth. It is the manufacturer’s obligation to ensure that any alternative plasticizer that is used be adequately tested by a third party testing laboratory to ensure that it does not pose a risk of injury under normal use or reasonably foreseeable misuse. Children’s products that are hazardous or contain a hazardous substance are automatically banned.

The Food and Drug Administration is responsible for upholding and protecting the safety and health of the United States’ general public. The FDA promotes standards regarding food, medications, medical devices, cosmetics, dietary supplements and tobacco. A manufacturer, seller or distributor is required to comply with FDA regulations and is recommended to work with third party testing facilities to ensure that all products meet the minimum standards and regulations.

Standards & Regulations

Some regions may mandate or require specific products be independently validated by an and accredited testing firms, when others allow for “self validation” to accepted or published international standards. Originally the American Society of Testing Materials, ASTM International is a leader in the development of voluntary standards. Many industries form committees under ASTM, which later develop standards that are later adopted into law.
International Organization for Standardization is an independent, non-governmental membership organization made up of member countries that develop and publish international safety standards for many industries.
European Standards (ENs) are based on member countries that develop standards through their own organizations and industries. Governed and published under the CEN – European Commiette for Standardization, EN has develop some of the worlds leading standards in many inudsties.
Standards Australia & New Zealand are leading publishers of standards for products directed to those specific markets, and like other regions, have developed some standards which lead in certain industries.
The Brazilian National Standards Organization or Associacao Brasileira de Normas Tecnicas is the normative body responsible for technological development in Brazil.
